A constitution is a body of fundamental principles according to which a state is constituted or governed.
The vast majority of contemporary constitutions describe the basic principles of the state, the structures and processes of government and the fundamental rights of citizens in a higher law that cannot be unilaterally changed by an ordinary legislative act. This higher law is usually referred to as a constitution.
The content and nature of a particular constitution, as well as how it relates to the rest
of the legal and political order, varies considerably between countries, and there is no
universal and uncontested definition of a constitution.
- To provide a set of basic rules that allow for minimal coordination amongst members of society.
- To specify who has the power to make decisions in a society. It decides how the government will be constituted.
- To set some limits on what a government can impose on its citizens. These limits are fundamental in the sense that government may never trespass on them.
- To enable the government to fulfil the aspirations of a society and create conditions for a just society.
